1. Definitions
1.1. “Stozhary” – Sole Proprietor (FOP) Krylova Anastasiia Olehivna, duly registered and operating in accordance with the laws of Ukraine.
1.2. Guest – any legally capable natural person who has reached the age of 18 (eighteen) years at the time of entering into this Agreement.
1.3. Services – temporary accommodation (lodging) services provided by “Stozhary”.
1.4. Policy – the Privacy Policy, including all amendments and supplements thereto.
1.5. Agreement – this User Agreement (public offer).
1.6. Booking – reservation of the accommodation facility for the Guest for a specified period of time.
1.7. Website – https://stozhary.com.ua
1.8. Payment System – a legal entity that processes and executes payments using bank cards and holds the appropriate licenses issued by the National Bank of Ukraine.
1.9. Promo Code – a unique code provided by “Stozhary” granting the Guest a discount on the Services under specified conditions.
2. Subject of the Agreement and General Provisions
2.1. “Stozhary” provides temporary accommodation Services to the Guest, and the Guest accepts and pays for such Services.
2.2. This Agreement constitutes a public contract (public offer).
2.3. The current version of the Agreement is published on the Website.
2.4. The Agreement shall be deemed concluded at the moment the Guest completes the Booking.
2.5. By making a Booking, the Guest confirms full and unconditional ознакомлення with and acceptance of the terms of this Agreement and the Privacy Policy.
2.6. The Services provided by “Stozhary” do not constitute a residential lease agreement within the meaning of the housing legislation of Ukraine.
2.7. The Guest confirms that they have full legal capacity and authority to enter into this Agreement.
3. Booking
3.1. To receive the Services, the Guest must complete a Booking via the Website and may not do so without accepting this Agreement and the Privacy Policy.
3.2. During the Booking process, the Guest provides the following information:
- full name;
- email address;
- phone number.
3.3. The provided information is used solely for the purpose of providing the Services and complying with legal requirements.
3.4. Completion of the Booking results in the reservation of the accommodation facility for the specified period.
3.5. The Guest is solely responsible for maintaining access to their Booking information.
3.6. Disclosure of information to third parties is permitted only in cases provided for by the laws of Ukraine.
3.7. “Stozhary” shall not be liable for any consequences arising from the Guest’s loss of access to Booking information.
4. Cost of Services and Payment Procedure
4.1. The Services are provided on a paid basis.
4.2. The cost of the Services is determined by “Stozhary” and published on the Website.
4.3. The cost of the Services is set in the national currency of Ukraine — the hryvnia.
4.4. Payment is accepted exclusively in non-cash form.
4.5. “Stozhary” does not collect, store, or process the Guest’s payment card details.
4.6. In the event of non-payment, “Stozhary” has the right to refuse to provide the Services.
5. Promo Codes
5.1. “Stozhary” may provide Promo Codes at its sole discretion.
5.2. Promo Codes may not be transferred, exchanged, restored, or redeemed for cash.
5.3. “Stozhary” reserves the right to cancel or modify the terms of Promo Code usage at any time.
6. Refusal to Provide Services
6.1. “Stozhary” has the right to refuse to provide the Services or cancel the Booking in the event of:
- violation of this Agreement by the Guest;
- provision of false information;
- violation of the laws of Ukraine;
- actions by the Guest that infringe the rights of “Stozhary” or third parties.
7. Refunds
7.1. The Guest may request a refund in the cases and under the conditions specified in this Agreement.
7.2. To process a refund, the Guest must provide the information and documents required by “Stozhary”.
7.3. Refunds are processed within thirty (30) calendar days from the date all required documents are received.
7.4. Failure to comply with the conditions or deadlines constitutes grounds for refusal of a refund.
8. Check-in, Check-out, and Cancellation Rules
8.1. Check-in time is from 15:00; check-out time is by 12:00.
8.2. Cancellation made at least five (5) calendar days prior to check-in entitles the Guest to a 100% refund.
8.3. Cancellation less than five (5) days before check-in or no-show entitles the Guest to a refund of 30% of the amount paid.
9. Accommodation Rules
9.1. The following is prohibited:
- smoking inside the house;
- parties, loud music, and noise disturbing others;
- inviting third parties without prior approval;
- transferring keys to third parties;
- removing furniture from the premises;
- improper use of plumbing facilities.
9.2. In the event of violation of these rules, “Stozhary” has the right to:
- claim compensation for damages;
- terminate the provision of Services without refund.
10. Hot Tub (Vat) Usage Rules
10.1. The use of cosmetic products in the water is prohibited.
10.2. Jumping into the hot tub is prohibited.
10.3. Children may use the hot tub only under adult supervision.
10.4. The Guest bears personal responsibility for their own safety.
10.5. Bathing pets in the hot tub is prohibited.
10.6. The Guest bears full financial responsibility for any damage caused by violation of these rules or instructions.
10.7. “Stozhary” has the right to claim compensation for repair or restoration costs in accordance with Section 12 of this Agreement.
11. Conduct on the Premises
11.1. Littering and lighting fires outside designated areas are prohibited.
11.2. Fireworks, firecrackers, confetti, and any weapons are prohibited.
11.3. Access to technical premises without administrative permission is prohibited.
12. Liability of the Parties
12.1. “Stozhary” shall not be liable for damage not caused by its fault.
12.2. The Guest is liable for damage or destruction of “Stozhary” property.
12.3. Repair or restoration costs must be paid prior to departure or within one (1) banking day from receipt of a demand.
12.4. In case of late payment, the Guest shall pay additional compensation of 10% of the outstanding amount for each ten (10) calendar days of delay.
12.5. The material liability of “Stozhary” is limited to the amount paid for the Services, except where such limitation is prohibited by law.
12¹. Force Majeure and Technical Limitations
12¹.1. “Stozhary” shall not be liable for full or partial inability to provide the Services or for temporary deterioration in their quality due to circumstances beyond its control, including but not limited to: freezing of pipes, engineering network failures, lack of water supply, power outages, generator failure, actions or inaction of utility providers, weather conditions, or other force majeure events.
12¹.2. In such cases, the Guest has the right to:
- refuse further accommodation with a refund for the actual unused period;
- refuse specific additional Services (including hot tub usage) with a refund for the unused Service.
12¹.3. If the Guest, having been informed of such circumstances, continues to stay or use the Services, this shall be deemed full and unconditional acceptance of the existing conditions and waiver of any further claims against “Stozhary”.
13. Personal Data
13.1. Personal data processing is carried out in accordance with the Privacy Policy.
13.2. By making a Booking, the Guest consents to the processing of personal data.
14. Governing Law and Amendments
14.1. This Agreement shall be governed by the laws of Ukraine.
14.2. “Stozhary” reserves the right to amend this Agreement unilaterally.
14.3. Continued use of the Services constitutes acceptance of such amendments.
15. Validity of Provisions
15.1. The invalidity of any provision shall not affect the validity of the remaining provisions.
15.2. In case of discrepancies, the provisions published on the Website shall prevail.
16. Sharing Information About Unreliable Guests
16.1. In the event of a material breach of this Agreement by the Guest, damage to “Stozhary” property, failure to fulfill financial obligations, or other actions violating the legitimate interests of “Stozhary”, the Guest grants explicit and irrevocable consent to the transfer of a limited amount of information about the Guest to third parties for the purpose of protecting the legitimate rights and interests of “Stozhary”.
16.2. The information that may be transferred under this section is strictly limited to:
- the Guest’s full name;
- the Guest’s phone number;
- extracts from correspondence or individual messages that directly confirm the fact of a breach, property damage, or refusal to fulfill financial obligations.
16.3. Information shall be transferred only to persons engaged in the provision of temporary accommodation services and solely to prevent damage to their property and protect their legitimate interests.
16.4. Such transfer shall not constitute public dissemination, defamation, or infringement of the Guest’s honor, dignity, or business reputation and shall be limited to factual descriptions without value judgments.
16.5. “Stozhary” does not transfer or distribute copies of identity documents, payment details, residential addresses, or photo/video materials unrelated to the recorded breach.
